GENERAL TERMS AND CONDITIONS for consumers

1. General Conditions

The General Terms and Conditions below in the version valid at the time of conclusion of the contract are part of the contract. The contract language is German.

Until further notice, the webshop is primarily aimed at the EU and Switzerland, and our offer is aimed at end consumers. For orders from other countries or B2B orders, please contact us at b2b@valoriavienna.com .

2. Offer and acceptance of offer

The presentation of the goods in the web shop does not constitute a binding offer in the legal sense. It is merely an invitation to you to make an offer. Your order represents an offer. A contract is only concluded after acceptance by VALORIA eU.

An order is only possible if all mandatory fields marked with * in the order form are filled in. If information is missing or we cannot process the order for other reasons, you will receive an error message. Before the order is finally submitted, you will have the opportunity to correct your order. You will receive supporting detailed information directly during the ordering process. As soon as the ordering process is complete, you will be notified by an information window saying "Your order has been confirmed. You will shortly receive an email with your order number." This does not constitute acceptance of your offer on our part.

Once we have received your order, you will be notified of receipt of your order via the email address you provided. This notification does not constitute acceptance of your offer on our part.

We can accept your offer within 7 working days by

  • we send you an order confirmation by email, whereby the time of receipt of the order confirmation by you is decisive, or

  • we send the ordered goods to you, whereby the time of receipt of the goods by you is decisive, or

  • we will ask you to pay after you have placed your order.

If several of the aforementioned alternatives exist, the contract is concluded at the time at which one of the aforementioned alternatives occurs first.

3. Product & Price


Product

VALORIA Vintage

Our VALORIA vintage items are all preloved and second-hand. Even though we carefully select our range and ensure high quality, the products may have visible signs of wear. We list these as extensively as necessary in the product description. We ask you to accept such defects as such. They are part of the unique story of the product, which gives each item its individual touch.


Warranty

The provisions on the statutory warranty apply. The warranty period for the delivery of movable goods is two years from receipt of the goods. Complaints based on statutory warranty claims or other complaints can be made using the contact details provided in the imprint.


Price

Our prices are fixed prices. The purchase price of our products corresponds to the price stated on our website, except for obvious errors. If we discover an incorrect price for a product you have ordered, we will contact you as soon as possible. You will then have the option of reconfirming the order at the correct price or cancelling it. If we are unable to contact you, the order will be considered cancelled. In this case, all amounts already paid will be refunded in full.

We are not obliged to sell you a product at an incorrect price, even if the order has already been confirmed, provided that the price was obviously and unmistakably incorrect and this error should have been apparent to you.

Our prices are also total prices. They include all taxes, including sales tax and duties, but do not include shipping costs. The shipping costs are listed separately at the end of the ordering process. You can find an overview of our shipping costs below under the heading "Shipping & Payment".

If delivery is to a non-EEA country, you will be responsible for all import and export costs, including any customs duties, fees and taxes.

We reserve the right to change prices at any time. However, orders already placed with an order confirmation issued are exempt from this.

  

4. Shipping & Payment


Shipment

We do not use any plastic in the packaging of our goods. Your order is usually processed within 3 working days. Orders are not dispatched or delivered on weekends or public holidays. If there are unexpected significant delays in the dispatch of your order, we will inform you by email or telephone.

As soon as your delivery is on the way, you will receive a tracking code with which you can track the status of your order.

If your order is to be delivered to a country outside the EU, please contact us by email at office@valoriavienna.com . In such cases, delivery times may be longer.

The prices shown on the website do not include shipping costs. These are added to the total amount according to the delivery address specified during the order process and are displayed to you before you finally place your order, which is subject to payment. The shipping and handling fees depend on the destination of the order, regardless of its size and weight:

According to Austria
Shipping costs: 5 €

In the EU
Shipping costs: 15 €

To Switzerland
Shipping costs: 20 €

Payment

We accept Visa, MasterCard, Paypal or direct bank transfer. You can also pay with Google Pay and Apple Pay. The payment options are displayed when you complete your order. Payments and refunds are charged in Euros (EUR).

When paying by means of an immediate payment method, such as direct bank transfer, credit card or PayPal, you undertake to pay the purchase price in full immediately after placing the order.

All our prices include value added tax (VAT). Depending on the destination country, additional charges such as taxes, duties, fees, charges or shipping costs may apply.

5. Right of revocation / withdrawal

You have the right to withdraw from your purchase contract within fourteen days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party other than the carrier designated by you took possession of the last goods.

To exercise your right of withdrawal, please inform us (VALORIA eU, Reinlgasse 36/1, 1140 Vienna, Austria, office@valoriavienna.com ) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email). You can use the attached model withdrawal form for this purpose, but this is not mandatory. To meet the withdrawal deadline, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period has expired.

If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional charges if you choose a delivery method other than the cheapest standard delivery offered by us). For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you. The refund will in any case be free of charge. We may refuse to refund until we have finally received the goods back.

You must return the goods to us promptly and in any event no later than fourteen days from the date on which you notify us that you have cancelled this agreement. The date of dispatch counts towards compliance with the deadline.
The costs for the return shipment as well as the associated costs for importing the goods into Austria are at your expense.
You only have to pay for any loss of value of the goods if this loss of value is determined during an examination of their quality, properties and functioning.
We can only accept unworn and unused goods with all labels still attached. There is no right of withdrawal for goods that have been made to customer specifications or are clearly tailored to personal needs.

6. Returns

Return conditions

You can return the items you ordered to us within 14 calendar days of receipt. Please understand that we can only accept unused items in their original condition and packaging for return. This means that our vintage items are not returnable. In order to be eligible for a return, your item must also be accompanied by a receipt or proof of purchase. Please note that we are not obliged to accept personalized items for return or exchange, provided they are not damaged or defective upon arrival.


Return & Refund

If your item meets the return requirements above, please contact us by email at returns@valoriavienna.com and let us know what you would like to return. Please include your name, full address, order number, the items you would like to return and the reason for return. Once we have confirmed your return, you can arrange shipping to the return address below.

When we receive the returned items, we will inspect your return. If it is OK, we will send you a confirmation and refund the purchase price. It may then take a few days for the credit to appear in your account, depending on the lender or bank's policies.

Please note that you are financially responsible for the return shipment until it reaches us. We therefore recommend using a trusted delivery service and, if possible, insured delivery. You are responsible for paying the return shipping costs and returning the item. The return shipping costs are to be borne by the customer*. Shipping costs are non-refundable.

7. Alternative dispute resolution
